The provider is not established in the EU. The GDPR applies because the service is directed at people in the Union (Art. 3(2) GDPR).

2. In short

• You use the calculator without an account and without giving your name.
• Street and house number never leave your browser. We store neither, only the location class (Wohnlage) derived from them.
• Template letters to your landlord are put together in your browser. We do not receive the names, addresses or contract details in them.
• We store your email address only with your consent and after you confirm it (double opt-in).
• Analytics set no cookies. The only cookie of the site stores your language when you switch the language.

3. Visiting the site and hosting

The site is operated and delivered by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. When you visit it, Cloudflare processes technically necessary connection data such as IP address, time, requested address and browser identification to deliver the site securely (Art. 6(1)(f) GDPR). Logs of the server functions (time, requested address, status code, error messages — no form content) are kept by Cloudflare for 3 days (free plan) or 7 days (paid plan). For transfers to the USA, Cloudflare states that it relies on its certification under the EU-U.S. Data Privacy Framework and additionally on the EU Standard Contractual Clauses.

4. Calculations

For every calculation we store: city, postal code, location class, the East or West assignment of the address according to the Mietspiegel, construction period, living area, net cold rent, furniture surcharge, whether the contract lacks a stated surcharge, the price and age of the furniture if entered, whether the rent is index-linked (with the starting rent and year), the result, the language, the time and the source of the visit (utm_source, e.g. “reddit”). We do not store street, house number or names. The purpose is to evaluate how the calculator is used and which rents it shows; the legal basis is our legitimate interest in this (Art. 6(1)(f) GDPR). Without an email address we cannot link a calculation to a person.

The location class is determined in your browser: it loads the public address directory of the Mietspiegel for the postal code you entered from our site and looks up street and house number in it. Only the postal code is transmitted.

The database is a Cloudflare D1 database with the jurisdiction “EU”: it runs and stores data only in data centres in the European Union.

Template letters (information request and complaint) are put together by your browser from your answers. Names, addresses, contract details and what the landlord told you are not transmitted to us and not stored; they are gone when you close the page. Links to tenant associations and debt collection service providers lead to their sites; we transmit no data to them, the link only carries the source “utm_source=mietcheck-moebliert”.

5. Email address

If you wish, we email you when the Mietrecht II bill is passed or rejected or its rules for furnished flats and index rents change, or when the calculator becomes available for your city. For this we store with your calculation the email address, the wording of your consent, the time of consent and confirmation, and a random code for the links in our emails. Only after you click the link in our confirmation email will we write to you again.

The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time with effect for the future (Art. 7(3) GDPR): via the link in every email or on the page Delete my data. Unconfirmed addresses are deleted after 7 days, confirmed ones no later than 12 months after confirmation. For technical reasons, deleted data remains in the database restore function (Cloudflare D1 Time Travel) for up to 30 days and is then overwritten automatically.

We send emails via the Brevo service. The contracting party is Sendinblue, a French simplified joint-stock company, 9-17 rue Salneuve, 75017 Paris, France, registered with the Paris Trade and Companies Register under number 498 019 298, as processor. Your email address and the content of the email are transmitted. Brevo uses sub-processors that may process data outside the EEA, including in the USA, Canada, Serbia and India; depending on the recipient the basis is the EU Standard Contractual Clauses, the EU-U.S. Data Privacy Framework or an adequacy decision of the European Commission. Brevo deletes or anonymises the data no later than 100 days after the end of the contract.

Our emails are plain text without images; their links lead directly to our site, not through a Brevo redirect. Brevo logs the sending and delivery of every email and keeps its content in its sending log.

6. Analytics

We use PostHog (PostHog, Inc., USA) as processor, namely its EU cloud with servers in Frankfurt am Main. PostHog is configured to set no cookies, store nothing in your browser and create no user profiles; the association ends when you leave the page. We record page views and steps in the calculator (e.g. “calculation submitted”, chosen city, overpayment range such as “101–300 €”, whether template letters were created, copied or saved) — no form input, no letter content and no email addresses; codes from email links are removed from addresses before sending. For this your browser connects to eu.i.posthog.com and eu-assets.i.posthog.com; PostHog processes your IP address. The legal basis is our legitimate interest in data-minimising analytics (Art. 6(1)(f) GDPR). For any transfers to the USA, PostHog relies on the EU-U.S. Data Privacy Framework and the EU Standard Contractual Clauses.

7. Language cookie

When you switch the language, we store your choice (“de” or “en”) in the cookie NEXT_LOCALE for 12 months so that the site opens in this language next time. The cookie is strictly necessary for this function you requested (§ 25(2) no. 2 TDDDG) and contains nothing else.

8. Links and fonts

Links to other sites (Mietspiegel, tenant associations, Bundestag) open those sites only when you click them; their privacy policies then apply. The site uses your device’s system fonts and loads no third-party fonts.

9. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21), and the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), for example where you live.
